This handout will define what an argument is and explain why you need one in most of your academic essays.

Arguments are everywhere

You may be surprised to hear that the word “argument” does not have to be written anywhere in your assignment for it to be an important part of your task. In fact, making an argument—expressing a point of view on a subject and supporting it with evidence—is often the aim of academic writing. Your instructors may assume that you know this and thus may not explain the importance of arguments in class.

Most material you learn in college is or has been debated by someone, somewhere, at some time. Even when the material you read or hear is presented as a simple fact, it may actually be one person’s interpretation of a set of information. Instructors may call on you to examine that interpretation and defend it, refute it, or offer some new view of your own. In writing assignments, you will almost always need to do more than just summarize information that you have gathered or regurgitate facts that have been discussed in class. You will need to develop a point of view on or interpretation of that material and provide evidence for your position.

Consider an example. For nearly 2000 years, educated people in many Western cultures believed that bloodletting—deliberately causing a sick person to lose blood—was the most effective treatment for a variety of illnesses. The claim that bloodletting is beneficial to human health was not widely questioned until the 1800s, and some physicians continued to recommend bloodletting as late as the 1920s. Medical practices have now changed because some people began to doubt the effectiveness of bloodletting; these people argued against it and provided convincing evidence. Human knowledge grows out of such differences of opinion, and scholars like your instructors spend their lives engaged in debate over what claims may be counted as accurate in their fields. In their courses, they want you to engage in similar kinds of critical thinking and debate.

Argumentation is not just what your instructors do. We all use argumentation on a daily basis, and you probably already have some skill at crafting an argument. The more you improve your skills in this area, the better you will be at thinking critically, reasoning, making choices, and weighing evidence.

Making a claim

What is an argument? In academic writing, an argument is usually a main idea, often called a “claim” or “thesis statement,” backed up with evidence that supports the idea. In the majority of college papers, you will need to make some sort of claim and use evidence to support it, and your ability to do this well will separate your papers from those of students who see assignments as mere accumulations of fact and detail. In other words, gone are the happy days of being given a “topic” about which you can write anything. It is time to stake out a position and prove why it is a good position for a thinking person to hold. See our handout on thesis statements .

Claims can be as simple as “Protons are positively charged and electrons are negatively charged,” with evidence such as, “In this experiment, protons and electrons acted in such and such a way.” Claims can also be as complex as “Genre is the most important element to the contract of expectations between filmmaker and audience,” using reasoning and evidence such as, “defying genre expectations can create a complete apocalypse of story form and content, leaving us stranded in a sort of genre-less abyss.” In either case, the rest of your paper will detail the reasoning and evidence that have led you to believe that your position is best.

When beginning to write a paper, ask yourself, “What is my point?” For example, the point of this handout is to help you become a better writer, and we are arguing that an important step in the process of writing effective arguments is understanding the concept of argumentation. If your papers do not have a main point, they cannot be arguing for anything. Asking yourself what your point is can help you avoid a mere “information dump.” Consider this: your instructors probably know a lot more than you do about your subject matter. Why, then, would you want to provide them with material they already know? Instructors are usually looking for two things:

  • Proof that you understand the material
  • A demonstration of your ability to use or apply the material in ways that go beyond what you have read or heard.

This second part can be done in many ways: you can critique the material, apply it to something else, or even just explain it in a different way. In order to succeed at this second step, though, you must have a particular point to argue.

Arguments in academic writing are usually complex and take time to develop. Your argument will need to be more than a simple or obvious statement such as “Frank Lloyd Wright was a great architect.” Such a statement might capture your initial impressions of Wright as you have studied him in class; however, you need to look deeper and express specifically what caused that “greatness.” Your instructor will probably expect something more complicated, such as “Frank Lloyd Wright’s architecture combines elements of European modernism, Asian aesthetic form, and locally found materials to create a unique new style,” or “There are many strong similarities between Wright’s building designs and those of his mother, which suggests that he may have borrowed some of her ideas.” To develop your argument, you would then define your terms and prove your claim with evidence from Wright’s drawings and buildings and those of the other architects you mentioned.

Do not stop with having a point. You have to back up your point with evidence. The strength of your evidence, and your use of it, can make or break your argument. See our handout on evidence . You already have the natural inclination for this type of thinking, if not in an academic setting. Think about how you talked your parents into letting you borrow the family car. Did you present them with lots of instances of your past trustworthiness? Did you make them feel guilty because your friends’ parents all let them drive? Did you whine until they just wanted you to shut up? Did you look up statistics on teen driving and use them to show how you didn’t fit the dangerous-driver profile? These are all types of argumentation, and they exist in academia in similar forms.

Every field has slightly different requirements for acceptable evidence, so familiarize yourself with some arguments from within that field instead of just applying whatever evidence you like best. Pay attention to your textbooks and your instructor’s lectures. What types of argument and evidence are they using? The type of evidence that sways an English instructor may not work to convince a sociology instructor. Find out what counts as proof that something is true in that field. Is it statistics, a logical development of points, something from the object being discussed (art work, text, culture, or atom), the way something works, or some combination of more than one of these things?

Be consistent with your evidence. Unlike negotiating for the use of your parents’ car, a college paper is not the place for an all-out blitz of every type of argument. You can often use more than one type of evidence within a paper, but make sure that within each section you are providing the reader with evidence appropriate to each claim. So, if you start a paragraph or section with a statement like “Putting the student seating area closer to the basketball court will raise player performance,” do not follow with your evidence on how much more money the university could raise by letting more students go to games for free. Information about how fan support raises player morale, which then results in better play, would be a better follow-up. Your next section could offer clear reasons why undergraduates have as much or more right to attend an undergraduate event as wealthy alumni—but this information would not go in the same section as the fan support stuff. You cannot convince a confused person, so keep things tidy and ordered.

Counterargument

One way to strengthen your argument and show that you have a deep understanding of the issue you are discussing is to anticipate and address counterarguments or objections. By considering what someone who disagrees with your position might have to say about your argument, you show that you have thought things through, and you dispose of some of the reasons your audience might have for not accepting your argument. Recall our discussion of student seating in the Dean Dome. To make the most effective argument possible, you should consider not only what students would say about seating but also what alumni who have paid a lot to get good seats might say.

You can generate counterarguments by asking yourself how someone who disagrees with you might respond to each of the points you’ve made or your position as a whole. If you can’t immediately imagine another position, here are some strategies to try:

  • Do some research. It may seem to you that no one could possibly disagree with the position you are arguing, but someone probably has. For example, some people argue that a hotdog is a sandwich. If you are making an argument concerning, for example, the characteristics of an exceptional sandwich, you might want to see what some of these people have to say.
  • Talk with a friend or with your teacher. Another person may be able to imagine counterarguments that haven’t occurred to you.
  • Consider your conclusion or claim and the premises of your argument and imagine someone who denies each of them. For example, if you argued, “Cats make the best pets. This is because they are clean and independent,” you might imagine someone saying, “Cats do not make the best pets. They are dirty and needy.”

Once you have thought up some counterarguments, consider how you will respond to them—will you concede that your opponent has a point but explain why your audience should nonetheless accept your argument? Will you reject the counterargument and explain why it is mistaken? Either way, you will want to leave your reader with a sense that your argument is stronger than opposing arguments.

When you are summarizing opposing arguments, be charitable. Present each argument fairly and objectively, rather than trying to make it look foolish. You want to show that you have considered the many sides of the issue. If you simply attack or caricature your opponent (also referred to as presenting a “straw man”), you suggest that your argument is only capable of defeating an extremely weak adversary, which may undermine your argument rather than enhance it.

It is usually better to consider one or two serious counterarguments in some depth, rather than to give a long but superficial list of many different counterarguments and replies.

Be sure that your reply is consistent with your original argument. If considering a counterargument changes your position, you will need to go back and revise your original argument accordingly.

Audience is a very important consideration in argument. Take a look at our handout on audience . A lifetime of dealing with your family members has helped you figure out which arguments work best to persuade each of them. Maybe whining works with one parent, but the other will only accept cold, hard statistics. Your kid brother may listen only to the sound of money in his palm. It’s usually wise to think of your audience in an academic setting as someone who is perfectly smart but who doesn’t necessarily agree with you. You are not just expressing your opinion in an argument (“It’s true because I said so”), and in most cases your audience will know something about the subject at hand—so you will need sturdy proof. At the same time, do not think of your audience as capable of reading your mind. You have to come out and state both your claim and your evidence clearly. Do not assume that because the instructor knows the material, he or she understands what part of it you are using, what you think about it, and why you have taken the position you’ve chosen.

Critical reading

Critical reading is a big part of understanding argument. Although some of the material you read will be very persuasive, do not fall under the spell of the printed word as authority. Very few of your instructors think of the texts they assign as the last word on the subject. Remember that the author of every text has an agenda, something that he or she wants you to believe. This is OK—everything is written from someone’s perspective—but it’s a good thing to be aware of. Take notes either in the margins of your source (if you are using a photocopy or your own book) or on a separate sheet as you read. Put away that highlighter! Simply highlighting a text is good for memorizing the main ideas in that text—it does not encourage critical reading. Part of your goal as a reader should be to put the author’s ideas in your own words. Then you can stop thinking of these ideas as facts and start thinking of them as arguments.

When you read, ask yourself questions like “What is the author trying to prove?” and “What is the author assuming I will agree with?” Do you agree with the author? Does the author adequately defend her argument? What kind of proof does she use? Is there something she leaves out that you would put in? Does putting it in hurt her argument? As you get used to reading critically, you will start to see the sometimes hidden agendas of other writers, and you can use this skill to improve your own ability to craft effective arguments.

In a bustling university town, there lived a student named Alex. Popular for creativity and wit, one challenge seemed insurmountable for Alex– the dreaded argumentative essay!

One gloomy afternoon, as the rain tapped against the window pane, Alex sat at his cluttered desk, staring at a blank document on the computer screen. The assignment loomed large: a 350-600-word argumentative essay on a topic of their choice . “Ah, Alex,” Professor Mitchell greeted with a warm smile. “What brings you here today?”

Alex confessed his struggles with the argumentative essay. After hearing his concerns, Professor Mitchell said, “Ah, the argumentative essay! Don’t worry, Let’s take a look at it together.” As he guided Alex to the corner shelf, Alex asked,

“What is an Argumentative Essay?”

The professor replied, “An argumentative essay is a type of academic writing that presents a clear argument or a firm position on a contentious issue. Unlike other forms of essays, such as descriptive or narrative essays, these essays require you to take a stance, present evidence, and convince your audience of the validity of your viewpoint with supporting evidence. A well-crafted argumentative essay relies on concrete facts and supporting evidence rather than merely expressing the author’s personal opinions . Furthermore, these essays demand comprehensive research on the chosen topic and typically follows a structured format consisting of three primary sections: an introductory paragraph, three body paragraphs, and a concluding paragraph.”

He continued, “Argumentative essays are written in a wide range of subject areas, reflecting their applicability across disciplines. They are written in different subject areas like literature and philosophy, history, science and technology, political science, psychology, economics and so on.

Alex asked,

“When is an Argumentative Essay Written?”

The professor answered, “Argumentative essays are often assigned in academic settings, but they can also be written for various other purposes, such as editorials, opinion pieces, or blog posts. Some situations to write argumentative essays include:

1. Academic assignments

In school or college, teachers may assign argumentative essays as part of coursework. It help students to develop critical thinking and persuasive writing skills .

2. Debates and discussions

Argumentative essays can serve as the basis for debates or discussions in academic or competitive settings. Moreover, they provide a structured way to present and defend your viewpoint.

3. Opinion pieces

Newspapers, magazines, and online publications often feature opinion pieces that present an argument on a current issue or topic to influence public opinion.

4. Policy proposals

In government and policy-related fields, argumentative essays are used to propose and defend specific policy changes or solutions to societal problems.

5. Persuasive speeches

Before delivering a persuasive speech, it’s common to prepare an argumentative essay as a foundation for your presentation.

Regardless of the context, an argumentative essay should present a clear thesis statement , provide evidence and reasoning to support your position, address counterarguments, and conclude with a compelling summary of your main points. The goal is to persuade readers or listeners to accept your viewpoint or at least consider it seriously.”

Elements of an Argumentative Essay

An argumentative essay comprises five essential components:

Claim in argumentative writing is the central argument or viewpoint that the writer aims to establish and defend throughout the essay. A claim must assert your position on an issue and must be arguable. It can guide the entire argument.

2. Evidence

Evidence must consist of factual information, data, examples, or expert opinions that support the claim. Also, it lends credibility by strengthening the writer’s position.

3. Counterarguments

Presenting a counterclaim demonstrates fairness and awareness of alternative perspectives.

4. Rebuttal

After presenting the counterclaim, the writer refutes it by offering counterarguments or providing evidence that weakens the opposing viewpoint. It shows that the writer has considered multiple perspectives and is prepared to defend their position.

The format of an argumentative essay typically follows the structure to ensure clarity and effectiveness in presenting an argument.

How to Write An Argumentative Essay

Here’s a step-by-step guide on how to write an argumentative essay:

1. Introduction

  • Begin with a compelling sentence or question to grab the reader’s attention.
  • Provide context for the issue, including relevant facts, statistics, or historical background.
  • Provide a concise thesis statement to present your position on the topic.

2. Body Paragraphs (usually three or more)

  • Start each paragraph with a clear and focused topic sentence that relates to your thesis statement.
  • Furthermore, provide evidence and explain the facts, statistics, examples, expert opinions, and quotations from credible sources that supports your thesis.
  • Use transition sentences to smoothly move from one point to the next.

3. Counterargument and Rebuttal

  • Acknowledge opposing viewpoints or potential objections to your argument.
  • Also, address these counterarguments with evidence and explain why they do not weaken your position.

4. Conclusion

  • Restate your thesis statement and summarize the key points you’ve made in the body of the essay.

What Is an Argumentative Essay?

An argumentative essay is a type of writing that presents the writer’s position or stance on a specific topic and uses evidence to support that position. The goal of an argumentative essay is to convince your reader that your position is logical, ethical, and, ultimately, right . In argumentative essays, writers accomplish this by writing:

  • A clear, persuasive thesis statement in the introduction paragraph
  • Body paragraphs that use evidence and explanations to support the thesis statement
  • A paragraph addressing opposing positions on the topic—when appropriate
  • A conclusion that gives the audience something meaningful to think about.

Introduction, body paragraphs, and a conclusion: these are the main sections of an argumentative essay. Those probably sound familiar. Where does arguing come into all of this, though? It’s not like you’re having a shouting match with your little brother across the dinner table. You’re just writing words down on a page!

...or are you? Even though writing papers can feel like a lonely process, one of the most important things you can do to be successful in argumentative writing is to think about your argument as participating in a larger conversation . For one thing, you’re going to be responding to the ideas of others as you write your argument. And when you’re done writing, someone—a teacher, a professor, or exam scorer—is going to be reading and evaluating your argument.

If you want to make a strong argument on any topic, you have to get informed about what’s already been said on that topic . That includes researching the different views and positions, figuring out what evidence has been produced, and learning the history of the topic. That means—you guessed it!—argumentative essays almost always require you to incorporate outside sources into your writing.

What Makes Argumentative Essays Unique?

Argumentative essays are different from other types of essays for one main reason: in an argumentative essay, you decide what the argument will be . Some types of essays, like summaries or syntheses, don’t want you to show your stance on the topic—they want you to remain unbiased and neutral.

In argumentative essays, you’re presenting your point of view as the writer and, sometimes, choosing the topic you’ll be arguing about. You just want to make sure that that point of view comes across as informed, well-reasoned, and persuasive.

Another thing about argumentative essays: they’re often longer than other types of essays. Why, you ask? Because it takes time to develop an effective argument. If your argument is going to be persuasive to readers, you have to address multiple points that support your argument, acknowledge counterpoints, and provide enough evidence and explanations to convince your reader that your points are valid.

Our 3 Best Tips for Picking a Great Argumentative Topic

The first step to writing an argumentative essay deciding what to write about! Choosing a topic for your argumentative essay might seem daunting, though. It can feel like you could make an argument about anything under the sun. For example, you could write an argumentative essay about how cats are way cooler than dogs, right?

It’s not quite that simple . Here are some strategies for choosing a topic that serves as a solid foundation for a strong argument.

Choose a Topic That Can Be Supported With Evidence

First, you want to make sure the topic you choose allows you to make a claim that can be supported by evidence that’s considered credible and appropriate for the subject matter ...and, unfortunately, your personal opinions or that Buzzfeed quiz you took last week don’t quite make the cut.

Some topics—like whether cats or dogs are cooler—can generate heated arguments, but at the end of the day, any argument you make on that topic is just going to be a matter of opinion. You have to pick a topic that allows you to take a position that can be supported by actual, researched evidence.

(Quick note: you could write an argumentative paper over the general idea that dogs are better than cats—or visa versa!—if you’re a) more specific and b) choose an idea that has some scientific research behind it. For example, a strong argumentative topic could be proving that dogs make better assistance animals than cats do.)

You also don’t want to make an argument about a topic that’s already a proven fact, like that drinking water is good for you. While some people might dislike the taste of water, there is an overwhelming body of evidence that proves—beyond the shadow of a doubt—that drinking water is a key part of good health.  

To avoid choosing a topic that’s either unprovable or already proven, try brainstorming some issues that have recently been discussed in the news, that you’ve seen people debating on social media, or that affect your local community. If you explore those outlets for potential topics, you’ll likely stumble upon something that piques your audience’s interest as well.  

Choose a Topic That You Find Interesting

Topics that have local, national, or global relevance often also resonate with us on a personal level. Consider choosing a topic that holds a connection between something you know or care about and something that is relevant to the rest of society. These don’t have to be super serious issues, but they should be topics that are timely and significant.

For example, if you are a huge football fan, a great argumentative topic for you might be arguing whether football leagues need to do more to prevent concussions . Is this as “important” an issue as climate change? No, but it’s still a timely topic that affects many people. And not only is this a great argumentative topic: you also get to write about one of your passions! Ultimately, if you’re working with a topic you enjoy, you’ll have more to say—and probably write a better essay .

Choose a Topic That Doesn’t Get You Too Heated

Another word of caution on choosing a topic for an argumentative paper: while it can be effective to choose a topic that matters to you personally, you also want to make sure you’re choosing a topic that you can keep your cool over. You’ve got to be able to stay unemotional, interpret the evidence persuasively, and, when appropriate, discuss opposing points of view without getting too salty.

In some situations, choosing a topic for your argumentative paper won’t be an issue at all: the test or exam will choose it for you . In that case, you’ve got to do the best you can with what you’re given.

The Thesis: The Argumentative Essay’s Backbone

You’ve chosen a topic or, more likely, read the exam question telling you to defend, challenge, or qualify a claim on an assigned topic. What do you do now?

You establish your position on the topic by writing a killer thesis statement ! The thesis statement, sometimes just called “the thesis,” is the backbone of your argument, the north star that keeps you oriented as you develop your main points, the—well, you get the idea.

In more concrete terms, a thesis statement conveys your point of view on your topic, usually in one sentence toward the end of your introduction paragraph . It’s very important that you state your point of view in your thesis statement in an argumentative way—in other words, it should state a point of view that is debatable.

And since your thesis statement is going to present your argument on the topic, it’s the thing that you’ll spend the rest of your argumentative paper defending. That’s where persuasion comes in. Your thesis statement tells your reader what your argument is, then the rest of your essay shows and explains why your argument is logical.

Why does an argumentative essay need a thesis, though? Well, the thesis statement—the sentence with your main claim—is actually the entire point of an argumentative essay. If you don’t clearly state an arguable claim at the beginning of your paper, then it’s not an argumentative essay. No thesis statement = no argumentative essay. Got it?

Other types of essays that you’re familiar with might simply use a thesis statement to forecast what the rest of the essay is going to discuss or to communicate what the topic is. That’s not the case here. If your thesis statement doesn’t make a claim or establish your position, you’ll need to go back to the drawing board.

Example Thesis Statements

Here are a couple of examples of thesis statements that aren’t argumentative and thesis statements that are argumentative

The sky is blue.

The thesis statement above conveys a fact, not a claim, so it’s not argumentative.

To keep the sky blue, governments must pass clean air legislation and regulate emissions.

The second example states a position on a topic. What’s the topic in that second sentence? The best way to keep the sky blue. And what position is being conveyed? That the best way to keep the sky blue is by passing clean air legislation and regulating emissions.

Some people would probably respond to that thesis statement with gusto: “No! Governments should not pass clean air legislation and regulate emissions! That infringes on my right to pollute the earth!” And there you have it: a thesis statement that presents a clear, debatable position on a topic.

Here’s one more set of thesis statement examples, just to throw in a little variety:

Spirituality and otherworldliness characterize A$AP Rocky’s portrayals of urban life and the American Dream in his rap songs and music videos.

The statement above is another example that isn’t argumentative, but you could write a really interesting analytical essay with that thesis statement. Long live A$AP! Now here’s another one that is argumentative:

To give students an understanding of the role of the American Dream in contemporary life, teachers should incorporate pop culture, like the music of A$AP Rocky, into their lessons and curriculum.

The argument in this one? Teachers should incorporate more relevant pop culture texts into their curriculum.

This thesis statement also gives a specific reason for making the argument above: To give students an understanding of the role of the American Dream in contemporary life. If you can let your reader know why you’re making your argument in your thesis statement, it will help them understand your argument better.

Breaking Down the Sections of An Argumentative Essay

Now that you know how to pick a topic for an argumentative essay and how to make a strong claim on your topic in a thesis statement, you’re ready to think about writing the other sections of an argumentative essay. These are the parts that will flesh out your argument and support the claim you made in your thesis statement.  

Like other types of essays, argumentative essays typically have three main sections: the introduction, the body, and the conclusion. Within those sections, there are some key elements that a reader—and especially an exam scorer or professor—is always going to expect you to include.

Let’s look at a quick outline of those three sections with their essential pieces here:

  • Introduction paragraph with a thesis statement (which we just talked about)
  • Support Point #1 with evidence
  • Explain/interpret the evidence with your own, original commentary (AKA, the fun part!)
  • Support Point #2 with evidence
  • Explain/interpret the evidence with your own, original commentary
  • Support Point #3 with evidence
  • New paragraph addressing opposing viewpoints (more on this later!)
  • Concluding paragraph

 Now, there are some key concepts in those sections that you’ve got to understand if you’re going to master how to write an argumentative essay. To make the most of the body section, you have to know how to support your claim (your thesis statement), what evidence and explanations are and when you should use them, and how and when to address opposing viewpoints. To finish strong, you’ve got to have a strategy for writing a stellar conclusion.

This probably feels like a big deal! The body and conclusion make up most of the essay, right? Let’s get down to it, then.

How to Write a Strong Argument

Once you have your topic and thesis, you’re ready for the hard part: actually writing your argument. If you make strategic choices—like the ones we’re about to talk about—writing a strong argumentative essay won’t feel so difficult.

There are three main areas where you want to focus your energy as you develop a strategy for how to write an argumentative essay: supporting your claim—your thesis statement—in your essay, addressing other viewpoints on your topic, and writing a solid conclusion. If you put thought and effort into these three things, you’re much more likely to write an argumentative essay that’s engaging, persuasive, and memorable...aka A+ material.

Focus Area 1: Supporting Your Claim With Evidence and Explanations

So you’ve chosen your topic, decided what your position will be, and written a thesis statement. But like we see in comment threads across the Internet, if you make a claim and don’t back it up with evidence, what do people say? “Where’s your proof?” “Show me the facts!” “Do you have any evidence to support that claim?”

Of course you’ve done your research like we talked about. Supporting your claim in your thesis statement is where that research comes in handy.

You can’t just use your research to state the facts, though. Remember your reader? They’re going to expect you to do some of the dirty work of interpreting the evidence for them. That’s why it’s important to know the difference between evidence and explanations, and how and when to use both in your argumentative essay.

What Evidence Is and When You Should Use It

Evidence can be material from any authoritative and credible outside source that supports your position on your topic. In some cases, evidence can come in the form of photos, video footage, or audio recordings. In other cases, you might be pulling reasons, facts, or statistics from news media articles, public policy, or scholarly books or journals.

There are some clues you can look for that indicate whether or not a source is credible , such as whether:

  • The website where you found the source ends in .edu, .gov, or .org
  • The source was published by a university press
  • The source was published in a peer-reviewed journal
  • The authors did extensive research to support the claims they make in the source

This is just a short list of some of the clues that a source is likely a credible one, but just because a source was published by a prestigious press or the authors all have PhDs doesn’t necessarily mean it is the best piece of evidence for you to use to support your argument.

In addition to evaluating the source’s credibility, you’ve got to consider what types of evidence might come across as most persuasive in the context of the argument you’re making and who your readers are. In other words, stepping back and getting a bird’s eye view of the entire context of your argumentative paper is key to choosing evidence that will strengthen your argument.

On some exams, like the AP exams , you may be given pretty strict parameters for what evidence to use and how to use it. You might be given six short readings that all address the same topic, have 15 minutes to read them, then be required to pull material from a minimum of three of the short readings to support your claim in an argumentative essay.

When the sources are handed to you like that, be sure to take notes that will help you pick out evidence as you read. Highlight, underline, put checkmarks in the margins of your exam . . . do whatever you need to do to begin identifying the material that you find most helpful or relevant. Those highlights and check marks might just turn into your quotes, paraphrases, or summaries of evidence in your completed exam essay.

What Explanations Are and When You Should Use Them

Now you know that taking a strategic mindset toward evidence and explanations is critical to grasping how to write an argumentative essay. Unfortunately, evidence doesn’t speak for itself. While it may be obvious to you, the researcher and writer, how the pieces of evidence you’ve included are relevant to your audience, it might not be as obvious to your reader.

That’s where explanations—or analysis, or interpretations—come in. You never want to just stick some quotes from an article into your paragraph and call it a day. You do want to interpret the evidence you’ve included to show your reader how that evidence supports your claim.

Now, that doesn’t mean you’re going to be saying, “This piece of evidence supports my argument because...”. Instead, you want to comment on the evidence in a way that helps your reader see how it supports the position you stated in your thesis. We’ll talk more about how to do this when we show you an example of a strong body paragraph from an argumentative essay here in a bit.

Understanding how to incorporate evidence and explanations to your advantage is really important. Here’s why: when you’re writing an argumentative essay, particularly on standardized tests or the AP exam, the exam scorers can’t penalize you for the position you take. Instead, their evaluation is going to focus on the way you incorporated evidence and explained it in your essay.

Focus Area 2: How—and When—to Address Other Viewpoints

Why would we be making arguments at all if there weren’t multiple views out there on a given topic? As you do research and consider the background surrounding your topic, you’ll probably come across arguments that stand in direct opposition to your position.

Oftentimes, teachers will ask you to “address the opposition” in your argumentative essay. What does that mean, though, to “ address the opposition ?”

Opposing viewpoints function kind of like an elephant in the room. Your audience knows they’re there. In fact, your audience might even buy into an opposing viewpoint and be waiting for you to show them why your viewpoint is better. If you don’t, it means that you’ll have a hard time convincing your audience to buy your argument.

Addressing the opposition is a balancing act: you don’t want to undermine your own argument, but you don’t want to dismiss the validity of opposing viewpoints out-of-hand or ignore them altogether, which can also undermine your argument.

This isn’t the only acceptable approach, but it’s common practice to wait to address the opposition until close to the end of an argumentative essay. But why?

Well, waiting to present an opposing viewpoint until after you’ve thoroughly supported your own argument is strategic. You aren’t going to go into great detail discussing the opposing viewpoint: you’re going to explain what that viewpoint is fairly, but you’re also going to point out what’s wrong with it.

It can also be effective to read the opposition through the lens of your own argument and the evidence you’ve used to support it. If the evidence you’ve already included supports your argument, it probably doesn’t support the opposing viewpoint. Without being too obvious, it might be worth pointing this out when you address the opposition.

Focus Area #3: Writing the Conclusion

It’s common to conclude an argumentative essay by reiterating the thesis statement in some way, either by reminding the reader what the overarching argument was in the first place or by reviewing the main points and evidence that you covered.

You don’t just want to restate your thesis statement and review your main points and call it a day, though. So much has happened since you stated your thesis in the introduction! And why waste a whole paragraph—the very last thing your audience is going to read—on just repeating yourself?

Here’s an approach to the conclusion that can give your audience a fresh perspective on your argument: reinterpret your thesis statement for them in light of all the evidence and explanations you’ve provided. Think about how your readers might read your thesis statement in a new light now that they’ve heard your whole argument out.

That’s what you want to leave your audience with as you conclude your argumentative paper: a brief explanation of why all that arguing mattered in the first place. If you can give your audience something to continue pondering after they’ve read your argument, that’s even better.

One thing you want to avoid in your conclusion, though: presenting new supporting points or new evidence. That can just be confusing for your reader. Stick to telling your reader why the argument you’ve already made matters, and your argument will stick with your reader.

A Strong Argumentative Essay: Examples

For some aspiring argumentative essay writers, showing is better than telling. To show rather than tell you what makes a strong argumentative essay, we’ve provided three examples of possible body paragraphs for an argumentative essay below.

Think of these example paragraphs as taking on the form of the “Argumentative Point #1 → Evidence —> Explanation —> Repeat” process we talked through earlier. It’s always nice to be able to compare examples, so we’ve included three paragraphs from an argumentative paper ranging from poor (or needs a lot of improvement, if you’re feeling generous), to better, to best.

All of the example paragraphs are for an essay with this thesis statement: 

Thesis Statement: In order to most effectively protect user data and combat the spread of disinformation, the U.S. government should implement more stringent regulations of Facebook and other social media outlets.

As you read the examples, think about what makes them different, and what makes the “best” paragraph more effective than the “better” and “poor” paragraphs. Here we go:

A Poor Argument

Example Body Paragraph: Data mining has affected a lot of people in recent years. Facebook has 2.23 billion users from around the world, and though it would take a huge amount of time and effort to make sure a company as big as Facebook was complying with privacy regulations in countries across the globe, adopting a common framework for privacy regulation in more countries would be the first step. In fact, Mark Zuckerberg himself supports adopting a global framework for privacy and data protection, which would protect more users than before.

What’s Wrong With This Example?

First, let’s look at the thesis statement. Ask yourself: does this make a claim that some people might agree with, but others might disagree with?

The answer is yes. Some people probably think that Facebook should be regulated, while others might believe that’s too much government intervention. Also, there are definitely good, reliable sources out there that will help this writer prove their argument. So this paper is off to a strong start!  

Unfortunately, this writer doesn’t do a great job proving their thesis in their body paragraph. First, the topic sentence—aka the first sentence of the paragraph—doesn’t make a point that directly supports the position stated in the thesis. We’re trying to argue that government regulation will help protect user data and combat the spread of misinformation, remember? The topic sentence should make a point that gets right at that, instead of throwing out a random fact about data mining.

Second, because the topic sentence isn’t focused on making a clear point, the rest of the paragraph doesn’t have much relevant information, and it fails to provide credible evidence that supports the claim made in the thesis statement. For example, it would be a great idea to include exactly what Mark Zuckerberg said ! So while there’s definitely some relevant information in this paragraph, it needs to be presented with more evidence.

A Better Argument  

This paragraph is a bit better than the first one, but it still needs some work. The topic sentence is a bit too long, and it doesn’t make a point that clearly supports the position laid out in the thesis statement. The reader already knows that mining user data is a big issue, so the topic sentence would be a great place to make a point about why more stringent government regulations would most effectively protect user data.

There’s also a problem with how the evidence is incorporated in this example. While there is some relevant, persuasive evidence included in this paragraph, there’s no explanation of why or how it is relevant . Remember, you can’t assume that your evidence speaks for itself: you have to interpret its relevance for your reader. That means including at least a sentence that tells your reader why the evidence you’ve chosen proves your argument.

A Best—But Not Perfect!—Argument  

Example Body Paragraph: Though Facebook claims to be implementing company policies that will protect user data and stop the spread of misinformation , its attempts have been unsuccessful compared to those made by the federal government. When PricewaterhouseCoopers conducted a Federal Trade Commission-mandated assessment of Facebook’s partnerships with Microsoft and the makers of the Blackberry handset in 2013, the team found limited evidence that Facebook had monitored or even checked that its partners had complied with Facebook’s existing data use policies. In fact, Facebook’s own auditors confirmed the PricewaterhouseCoopers findings, despite the fact that Facebook claimed that the company was making greater attempts to safeguard users’ personal information. In contrast, bills written by Congress have been more successful in changing Facebook’s practices than Facebook’s own company policies have. According to The Washington Post, The Honest Ads Act of 2017 “created public demand for transparency and changed how social media companies disclose online political advertising.” These policy efforts, though thus far unsuccessful in passing legislation, have nevertheless pushed social media companies to change some of their practices by sparking public outrage and negative media attention.

Why This Example Is The Best

This paragraph isn’t perfect, but it is the most effective at doing some of the things that you want to do when you write an argumentative essay.

First, the topic sentences get to the point . . . and it’s a point that supports and explains the claim made in the thesis statement! It gives a clear reason why our claim in favor of more stringent government regulations is a good claim : because Facebook has failed to self-regulate its practices.

This paragraph also provides strong evidence and specific examples that support the point made in the topic sentence. The evidence presented shows specific instances in which Facebook has failed to self-regulate, and other examples where the federal government has successfully influenced regulation of Facebook’s practices for the better.

Perhaps most importantly, though, this writer explains why the evidence is important. The bold sentence in the example is where the writer links the evidence back to their opinion. In this case, they explain that the pressure from Federal Trade Commission and Congress—and the threat of regulation—have helped change Facebook for the better.

Why point out that this isn’t a perfect paragraph, though? Because you won’t be writing perfect paragraphs when you’re taking timed exams either. But get this: you don’t have to write perfect paragraphs to make a good score on AP exams or even on an essay you write for class. Like in this example paragraph, you just have to effectively develop your position by appropriately and convincingly relying on evidence from good sources.

This is all great information, right? If (when) you have to write an argumentative essay, you’ll be ready. But when in doubt, remember these three things about how to write an argumentative essay, and you’ll emerge victorious:

From making sure you’re addressing your prompt, to really digging into your sources, to proofreading your final paper...you’ll need to actively and pay attention! This is especially true if you’re writing on the clock, like during an AP exam.

Define your position clearly in your thesis statement and stick to that position! The thesis is the backbone of your paper, and every paragraph should help prove your thesis in one way or another. But sometimes you get to the end of your essay and realize that you’ve gotten off topic, or that your thesis doesn’t quite fit. Don’t worry—if that happens, you can always rewrite your thesis to fit your paper!

Takeaway #3: Use Sources to Develop Your Argument—and Explain Them

Nothing is as powerful as good, strong evidence. First, make sure you’re finding credible sources that support your argument. Then you can paraphrase, briefly summarize, or quote from your sources as you incorporate them into your paragraphs. But remember the most important part: you have to explain why you’ve chosen that evidence and why it proves your thesis.

This skill helps our students engage with the world, process their thoughts, and discover their opinions.

In this article, we will use the terms ‘discussion’ and ‘argument’ interchangeably. But, it is worth noting that the real purpose of a discussion is to explore a variety of arguments to arrive at the truth, where possible.

Teaching our students the basics of argument and discussion is not about tooling them up to ‘win’. The discussion processes are as much about the student discovering what they think as they are about persuading others to agree. As students mature and get more practised in their discussions, they will discover that often discussion is a necessary precursor to having an opinion on a given topic, no matter how basic or advanced that topic may be.

For students, the discussion often bridges the gap between speaking and listening learning areas and reading and writing. It is for this reason that we will look at some oral discussion activities before examining how to approach the writing of discussion pieces in the classroom. These oral activities can serve as excellent pre-writing exercises for the students to prepare their thoughts and ideas before writing. They also work well as standalone oral activities that allow students to practice their persuasive speaking skills and all that entails.

DIFFERENCES BETWEEN AN ARGUMENTIVE ESSAY AND A PERSUASIVE ESSAY?

  • A PERSUASIVE ESSAY presents EMOTION, and the author’s purpose is to try and CONVINCE YOU to think as they do. It is about the sales pitch more so than an emphasis on the specifications and details of the subject area.
  • An ARGUMENTATIVE ESSAY presents EVIDENCE and LOGIC at its core. Whilst you are still trying to influence your readers’ thinking on a given topic, you shouldn’t pull on your reader’s heartstrings nearly as much as presenting a mountain of facts, data and specifics that cannot be ignored.

POINTS TO CONSIDER BEFORE WRITING YOUR ESSAY

Pick your poison wisely: choosing discussion topics.

The beauty of incorporating discussion and argument into the classroom is that you can quickly build your lessons around the student’s interests. From the youngest students in elementary to those wizened old owls in high school, a quick class brainstorm will reveal a wealth of juicy topics for them to get their mental teeth into. In this day and age of political correctness, however, be sensitive to the selection of a topic for discussion appropriate to the demographics of your class. While controversial topics can lead to the most lively of discussions, it is best to avoid subjects too close to the bone that may cause deep rifts in the class dynamic. If in doubt, rather than take suggestions from the class, have some exciting topics pre-prepared for the students to choose from or to vote on.

An Argumentative Essay Outline

The aim of a well-written discussion text is to present information and opinions that express more than one viewpoint. This will often take the form of a newspaper report or a leaflet.  Regardless of the genre of the writing undertaken, however, some common factors apply to most discussion texts. Most often, they are written in the present tense and are commonly structured in the following way:

INTRODUCTION

No better place to begin than at the start. The title should typically be a general statement or even a question that draws attention to a specific issue. For example, Should cell phones be banned in schools?

  The introduction section itself should usually be relatively brief and open with a brief statement on the issue and provide some background to the issue to be discussed. It will outline the arguments to be reviewed ahead, but the introduction itself does not usually contain any of the student’s opinions or views on the topic in question. There are, however, several things to consider when writing the introduction.

As with any genre of writing, it is essential to grab the reader’s attention from the outset, and discussion texts are no different. Fortunately, there are several tried and tested methods of achieving this. Here are a few that may be suitable openers for your students’ discussion writing:

●     open with a quotation relevant to the topic being addressed. A well-chosen quotation can grab the attention of even the most distracted of readers and compel them to read more!

●     a surprising fact is another excellent way to grab the reader’s attention and illuminate the topic to be discussed. Not only is it engaging, but informative too!

●     a joke. Everyone loves a laugh, and a joke can provide an excellent in to the student’s writing. But, encourage your students to be careful here; the suitability of a humorous opening will largely depend on the topic being discussed. As jokes may not always be appropriate to the material, they must be used wisely.

THE ARGUMENTS

In writing a balanced argument, students must consider the positives and negatives of the issue. The body of the text should be focused on presenting the pros and cons, the for and against arguments, relating to the central issue. This is why oral starter activities can be so valuable as prewriting exercises.

After the student has laid out the topic in their introduction by providing the necessary background information, it is time for the student to consider laying out the case for the argument.

Using time connectives is an excellent way for students to organize their information. Adverbs of time, such as firstly, secondly, next, then etc. and phrases such as, in addition to, therefore etc., can help students structure their information chronologically and coherently.

Depending on the length of the text, it is typically recommended that each paragraph consists of a single point. It is important to remind students that in the presentation of a balanced argument, they should not express their own bias or even their own point of view , instead, they are laying out both sides of the argument for the reader and should give equal weight to each point of view. When exploring each point, whether for or against, the PEE method can be a helpful way to aid students in structuring their paragraphs and give the direction of their argument:

P = Point (Student makes their point at the beginning of the paragraph)

E = Evidence (Student provides evidence that underpins this point)

E =Explain (Student explores point further and ties back to the central issue)

When the student has considered each of their points for the argument, for example, three separate paragraphs each making three points for the argument, it is now time to consider and do the same for the argument against . The purpose here is to set up an opposition to the previously made points, to offer the other side of the story.

Encourage students here to use words and phrases that set up this contrast, for example, however , contrastingly , on the other hand , etc. Displaying these words and phrases in a word bank can also be a great way to help weaker students to organize their writing.

In the conclusion, the student reviews the information, summarises the arguments made and weighs up the issue in light of the available evidence. At this point, students can offer their own opinion in favor or against the issue at hand, but only if it is appropriate to the genre of the discussion text. 

Students often find it difficult to know how to end their writing. One excellent way to finish their discussion is to end it with a question, a challenge to the readers to form their own opinion on the issue in light of the evidence that has been presented.

TIPS FOR WRITING A GREAT ARGUMENTATIVE ESSAY

  • Make sure you clearly explain the topic to the audience before you get into taking sides.
  • When you have selected a topic, ensure that you research both sides of the argument thoroughly before writing.
  • In your conclusion, make it clear which side of the argument you side on, even make a recommendation but allow the reader to keep an open mind.
  • Keep everything in order.
  • List all the items that will be required to complete the task.
  • Use paragraphs effectively. Each new argument should start with a new paragraph.
  • Keep your arguments short, sharp and to the point.
  • Use the correct language and terms.

ORAL ACTIVITIES TO GET IN THE ‘DISCUSSION’ ZONE

ORAL ACTIVITY 1: PROS AND CONS

This great warm-up exercise allows students to explore a topic, weigh up the different possible opinions, and even offers a chance for the student to discover what they think about a topic. This exercise can also serve as a fantastic prep exercise for a piece of extended writing and involves minimal prep.

Pros and Cons involve students making a list of a given topic’s pro and con arguments. This is often best done in small groups where the students can brainstorm together and bounce ideas off one another. The process of comparing the for and against of an issue gives them an awareness of the range of opinions on the matter, helping them on their way to forming their own opinion.

The list created during this activity can also provide a helpful outline that can work as a springboard for later writing. It is a great way to organize ideas coherently that can seamlessly feed into the writing process described later below.

BY LISTING POINTS AND COUNTERPOINTS TOGETHER, STUDENTS GET INTO THE PRACTICE OF DEVELOPING A NUANCED AND CONSIDERED ARGUMENT RATHER THAN PRODUCING MERE PROPAGANDA. THIS HELPS THEM INTERNALIZE THE IMPORTANCE OF GIVING FULL CONSIDERATION TO A RANGE OF DIFFERING OPINIONS ABOUT THE SAME TOPIC.

ORAL ACTIVITY 2: THINK – PAIR – SHARE

This activity requires almost zero prep, other than giving the class a topic to get their teeth into!

First, have the students think silently about the topic for a minute or two. They may scratch down doodles or brief notes of their ideas on a piece of paper to use in the discussion portion of this exercise, but this is not a writing activity!

Then, partner them up with another student. At this stage, you may consider differentiation; you may wish to match students with other students of equal ability or with a stronger one as support. Either way, students discuss the topic with their partners for a predetermined number of minutes. The length of time will be dictated by the students’ ages and abilities. Experiment to find the most suitable length of time for your class.

After the time is up, students can share their opinions with the class. You can also scribe the ideas generated by each group onto a master list displayed on the whiteboard as part of a pre-writing exercise. This can also be an excellent exercise to begin the preparation for a formal debate, as it affords the students opportunities to think on their feet, engage with differing opinions, and to work on public speaking skills such as body language.

ORAL ACTIVITY 3. SPEED-DATING FUN

This is a pacy, fun activity to get a lively conversation going in a manner that apes the popular speed dating format – but with a more virtuous intent! You can organize the desks in rows facing each other or in concentric circles in the middle of the classroom.

Choose one row or circle to be mobile. Give students a list of topics to discuss and start the clock. After three minutes or so, signal the time is up and instruct students to move to the following table. At the next station, they can either discuss the same topic or move on to the next topic on their list.

Of course, you may shorten or lengthen the allotted time based on the student’s abilities or the complexities of the topics. However, as this exercise works best in fun and fast-paced, and the aim is for each student to have the opportunity to speak with every other student, it is often best to keep the topics fairly straightforward. Questions like Is it better to live in the town than the country? or Do dogs make better pets than cats? work well here.

THE IMPORTANCE OF DISCUSSION IN THE CLASSROOM

The discrete teaching of discussion and argument in the classroom is essential. It offers students invaluable opportunities to test their opinions and ideas with their peers in a safe environment. Students learn that disagreement is inevitable and not fatal! They learn, too, that it is okay to revise an opinion in the light of compelling evidence they had not previously considered.

Discussion is a proving ground for ideas. Ideas tested in the arena of classroom discussion will likely be expressed much more coherently in written form. Often, students are not fully aware of exactly how they think on an issue until they have had a chance to try out their embryonic ideas with each other in a public discussion. It also helps students avoid the dangers of the echo chamber of their minds where frequently their ideas existed without challenge.

Encouraging our students to engage in respectful and productive disagreement is perhaps one of the most important skills we can help them develop.

AUTHENTIC ASSESSMENT OPPORTUNITIES

Discussion activities offer tremendous opportunities for some informal assessment that helps with planning to best meet the needs of your students in future lessons. The fact that they are not teacher-led gives the teacher a chance to take a backseat and give full attention to the students’ conversations. This allows you to spot areas of difficulty and gaps in learning – all valuable information that will be priceless for effective future lesson planning.

Argumentative Essays

You may have heard it said that all writing is an argument of some kind. Even if you’re writing an informative essay, you still have the job of trying to convince your audience that the information is important. However, there are times you’ll be asked to write an essay that is specifically an argumentative piece.

An argumentative essay is one that makes a clear assertion or argument about some topic or issue. When you’re writing an argumentative essay, it’s important to remember that an academic argument is quite different from a regular, emotional argument. Note that sometimes students forget the academic aspect of an argumentative essay and write essays that are much too emotional for an academic audience. It’s important for you to choose a topic you feel passionately about (if you’re allowed to pick your topic), but you have to be sure you aren’t too emotionally attached to a topic. In an academic argument, you’ll have a lot more constraints you have to consider, and you’ll focus much more on logic and reasoning than emotions.

Argumentative essays are quite common in academic writing and are often an important part of writing in all disciplines. You may be asked to take a stand on a social issue in your introduction to writing course, but you could also be asked to take a stand on an issue related to health care in your nursing courses or make a case for solving a local environmental problem in your biology class. And, since argument is such a common essay assignment, it’s important to be aware of some basic elements of a good argumentative essay.

When your professor asks you to write an argumentative essay, you’ll often be given something specific to write about. For example, you may be asked to take a stand on an issue you have been discussing in class. Perhaps, in your education class, you would be asked to write about standardized testing in public schools. Or, in your literature class, you might be asked to argue the effects of protest literature on public policy in the United States.

However, there are times when you’ll be given a choice of topics. You might even be asked to write an argumentative essay on any topic related to your field of study or a topic you feel that is important personally.

Whatever the case, having some knowledge of some basic argumentative techniques or strategies will be helpful as you write. Below are some common types of arguments.

Causal Arguments

  • In this type of argument, you argue that something has caused something else. For example, you might explore the causes of the decline of large mammals in the world’s ocean and make a case for your cause.

Evaluation Arguments

  • In this type of argument, you make an argumentative evaluation of something as “good” or “bad,” but you need to establish the criteria for “good” or “bad.” For example, you might evaluate a children’s book for your education class, but you would need to establish clear criteria for your evaluation for your audience.

Proposal Arguments

  • In this type of argument, you must propose a solution to a problem. First, you must establish a clear problem and then propose a specific solution to that problem. For example, you might argue for a proposal that would increase retention rates at your college.

Narrative Arguments

  • In this type of argument, you make your case by telling a story with a clear point related to your argument. For example, you might write a narrative about your experiences with standardized testing in order to make a case for reform.

Rebuttal Arguments

  • In a rebuttal argument, you build your case around refuting an idea or ideas that have come before. In other words, your starting point is to challenge the ideas of the past.

Definition Arguments

  • In this type of argument, you use a definition as the starting point for making your case. For example, in a definition argument, you might argue that NCAA basketball players should be defined as professional players and, therefore, should be paid.

In the image below, you can see a recommended structure for argumentative essays. It starts with the topic sentence, which establishes the main idea of the essay. Next, this hypothesis is developed in the development stage. Then, the rebuttal, or the refutal of the main counter argument or arguments. Then, again, development of the rebuttal. This is followed by an example, and ends with a summary. This is a very basic structure, but it gives you a bird-eye-view of how a proper argumentative essay can be built.

Writing an argumentative essay (for a class, a news outlet, or just for fun) can help you improve your understanding of an issue and sharpen your thinking on the matter. Using researched facts and data, you can explain why you or others think the way you do, even while other reasonable people disagree.

What Is an Argumentative Essay?

An argumentative essay is an explanatory essay that takes a side.

Instead of appealing to emotion and personal experience to change the reader’s mind, an argumentative essay uses logic and well-researched factual information to explain why the thesis in question is the most reasonable opinion on the matter.  

Over several paragraphs or pages, the author systematically walks through:

  • The opposition (and supporting evidence)
  • The chosen thesis (and its supporting evidence)

At the end, the author leaves the decision up to the reader, trusting that the case they’ve made will do the work of changing the reader’s mind. Even if the reader’s opinion doesn’t change, they come away from the essay with a greater understanding of the perspective presented — and perhaps a better understanding of their original opinion.

All of that might make it seem like writing an argumentative essay is way harder than an emotionally-driven persuasive essay — but if you’re like me and much more comfortable spouting facts and figures than making impassioned pleas, you may find that an argumentative essay is easier to write. 

Plus, the process of researching an argumentative essay means you can check your assumptions and develop an opinion that’s more based in reality than what you originally thought. I know for sure that my opinions need to be fact checked — don’t yours?

So how exactly do we write the argumentative essay?

How do you start an argumentative essay

First, gain a clear understanding of what exactly an argumentative essay is. To formulate a proper topic sentence, you have to be clear on your topic, and to explore it through research.

Students have difficulty starting an essay because the whole task seems intimidating, and they are afraid of spending too much time on the topic sentence. Experienced writers, however, know that there is no set time to spend on figuring out your topic. It's a real exploration that is based to a large extent on intuition.

Use this checklist to tackle your essay one step at a time:

1. Research an issue with an arguable question

To start, you need to identify an issue that well-informed people have varying opinions on. Here, it’s helpful to think of one core topic and how it intersects with another (or several other) issues. That intersection is where hot takes and reasonable (or unreasonable) opinions abound. 

I find it helpful to stage the issue as a question.

For example: 

Is it better to legislate the minimum size of chicken enclosures or to outlaw the sale of eggs from chickens who don’t have enough space?

Should snow removal policies focus more on effectively keeping roads clear for traffic or the environmental impacts of snow removal methods?

Once you have your arguable question ready, start researching the basic facts and specific opinions and arguments on the issue. Do your best to stay focused on gathering information that is directly relevant to your topic. Depending on what your essay is for, you may reference academic studies, government reports, or newspaper articles.

‍ Research your opposition and the facts that support their viewpoint as much as you research your own position . You’ll need to address your opposition in your essay, so you’ll want to know their argument from the inside out.

2. Choose a side based on your research

You likely started with an inclination toward one side or the other, but your research should ultimately shape your perspective. So once you’ve completed the research, nail down your opinion and start articulating the what and why of your take.

4. Freewrite or outline to think through your argument

Is your brain buzzing yet? At this point in the process, it can be helpful to take out a notebook or open a fresh document and dump whatever you’re thinking on the page.

Where should your essay start? What ground-level information do you need to provide your readers before you can dive into the issue?

Use your organized evidence document from step 3 to think through your argument from beginning to end, and determine the structure of your essay.

There are three typical structures for argumentative essays:

  • Make your argument and tackle opposition claims one by one, as they come up in relation to the points of your argument - In this approach, the whole essay — from beginning to end — focuses on your argument, but as you make each point, you address the relevant opposition claims individually. This approach works well if your opposition’s views can be quickly explained and refuted and if they directly relate to specific points in your argument.
  • Make the bulk of your argument, and then address the opposition all at once in a paragraph (or a few) - This approach puts the opposition in its own section, separate from your main argument. After you’ve made your case, with ample evidence to convince your readers, you write about the opposition, explaining their viewpoint and supporting evidence — and showing readers why the opposition’s argument is unconvincing. Once you’ve addressed the opposition, you write a conclusion that sums up why your argument is the better one.
  • Open your essay by talking about the opposition and where it falls short. Build your entire argument to show how it is superior to that opposition - With this structure, you’re showing your readers “a better way” to address the issue. After opening your piece by showing how your opposition’s approaches fail, you launch into your argument, providing readers with ample evidence that backs you up.

As you think through your argument and examine your evidence document, consider which structure will serve your argument best. Sketch out an outline to give yourself a map to follow in the writing process. You could also rearrange your evidence document again to match your outline, so it will be easy to find what you need when you start writing.

5. Write your first draft

You have an outline and an organized document with all your points and evidence lined up and ready. Now you just have to write your essay.

In your first draft, focus on getting your ideas on the page. Your wording may not be perfect (whose is?), but you know what you’re trying to say — so even if you’re overly wordy and taking too much space to say what you need to say, put those words on the page.

Follow your outline, and draw from that evidence document to flesh out each point of your argument. Explain what the evidence means for your argument and your opposition. Connect the dots for your readers so they can follow you, point by point, and understand what you’re trying to say.

How to Approach an Argumentative Essay

An argumentative essay should be based on rational thinking. The approach of the author should be objective in nature. Rather than basing your argument on emotions, you should rely on logic and evidence.

While there are many approaches to writing an argumentative essay, the two most common methods that would enable you to write a first-class piece are: The  Rogerian  method and the  Toulmin  method.

Toulmin Argument Building Model

The  Toulmin   method involves four key steps to build an argument. The same strategy can be applied throughout the essay where necessary.

  • Make a  claim
  • Present your evidence to support the claim
  • Provide the warrant which explains the evidence to support the claim
  • State the potential refutation to  the claim, which involves establishing the limits of the argument to demonstrate that you took into consideration the alternates.

The  Rogerian  model of building an argument also involves four steps:

This is where you present the details to support your arguments. The  main body  of your argumentative essay should present analysis, evidence, and interpretation to persuade readers to agree with your viewpoint.

What is an argument?

Essays are generally structured as arguments . 

After you analyse the essay question, you read (or re-read) texts from your reading list and texts found through your own research. On the basis of your reading, you develop a general view, or answer, to the essay question, which you then defend with the evidence found in your reading. 

The view that you defend in your essay is called a thesis statement .

What is a thesis statement ?

Your thesis statement states your position on the essay question, which you will defend with one or more arguments in the body of the essay. Your thesis statement is essentially your answer to the essay question, expressed in a single sentence, and will be based on your reading.

Your thesis statement is:

  • Is developed through reading. What does the literature say about the issue referred to in the essay question?
  • Provided in the introduction 
  • Usually follows a brief outline of the problem, or issue, addressed by the essay question 
  • Is specific and relevant to the essay question

Examples of thesis statements

Essay question:  ‘Discuss the claim that mass public schooling provides equal access to high quality education.’

Thesis:   This essay will argue  that  while the introduction of mass public schooling was a great advancement in ensuring equal access to education, the influence of socio-economic status on educational attainment has not yet been overcome.  

"This essay will argue"  → Signposting phrase to introduce your argument

Example 2: 

Essay question:  To what extent is there a 'participation crisis' in UK politics?

Thesis:  If we define 'participation' as xyz, it can be argued that there is not in fact a participation crisis in UK politics. 

   

A note on thesis statements : 

It can feel scary to commit yourself to a thesis statement because thesis statements seem to speak with tremendous certainty! But..."The influence of socio-economic status on educational attainment has not yet been overcome" simply indicates the general destination that the essay will be moving toward. It does not have to be a highly developed statement of how things are. Try to develop a general, 'working' thesis to give your writing direction. You can make it more precise and nuanced as you work through various drafts of your essay.

To write an effective argument, you will need to provide the following:

Planning Your Essay

Step 1 Work through the...

  • For instance, maybe the question is, "Immigration has been a heated topic on the national level for many years. With issues like the DREAM Act and President Trump's stances on policy, it's likely to remain a central issue. Using authoritative resources to back up your argument, take a stance on immigration policy, establishing whether you think it should be more or less strict and why."
  • You can establish that the main topic is immigration policy from the sentence, "Take a stance on immigration policy."
  • If you're having trouble understanding the question, don't be afraid to talk to the professor. They can help you better understand what they're asking for.

Step 2 Perform initial research to understand the issue.

  • If your essay will be based off a discussion had in class, ask your instructor if you can use class notes as a primary source.
  • Look for respected news sources, as well as websites with ".edu" and ".gov" extensions.
  • You may need to look up information on the DREAM Act or President Trump's policies to help you understand the question, for example. For this part, you don't need to take extensive notes, as you're just trying to get a feel for the subject.

Step 3 Take a side on the issue to begin outlining your essay.

  • If you were given a text to base your essay on, make sure that text has enough evidence to support your chosen position.

Step 4 Add the main points you'd like to cover to your outline.

  • Use Roman numerals on your page to mark your main ideas. Write a main point by each Roman numeral. You should only cover 3 to 4 main points in a relatively short essay, such as one that's 3 to 5 pages.

Step 5 Find research to support your points.

  • Your main sources should be books or ebooks, journal articles from academic journals, and credible websites. You can also use high quality news articles if they're applicable to your topic.

Step 6 Take notes that include citations.

  • For a book, you should include the author's name, the editor's name (if applicable), the title of the book, the publication year, the publication city, the edition, and the title of the book chapter in an anthology by multiple authors.
  • For a journal, include the author's name, the journal title, the article title, the digital object identifier (DOI), the ISSN, the publication date, the volume (if applicable), the issue (if applicable), and the page numbers for the journal article.
  • If you're searching in a database, you can often ask the database to save this information for you, but you should include identifiers on your notes.

Step 7 Fill in your outline to finish planning your essay.

  • For example, if one of your main points is "Immigration increases diversity," some of your points underneath might be "Brings in new cuisines," and "Brings in new art."
  • Find examples from your research, and add notes to each point to fill them in.

Writing the Introduction

Step 1 Begin with a hook such as a quotation or anecdote to engage readers.

  • For an example or anecdote, start by telling a short story about something relevant to your topic. For instance, you might write the following for an essay on immigration, "When I was 4-years-old, my parents told me we were going on a long trip. After a bus ride, we spent nights walking, my dad carrying me most of the way. One day, we crossed a river. That day marked our first day in our new country."

Step 2 Introduce your topic in your transition sentences.

  • For example, you might write, "Immigration is a highly-debated issue. It is controversial because some people fear how it affects the resources of the country the people are immigrating to, while others believe the improved quality of life for immigrants is what’s most important."

Step 3 Work on a thesis statement to establish your argument.

  • For instance, your thesis statement might be, "Immigration is good for the country because it increases diversity, infuses the country with new talent, and broadens the population's perspective, and it should be encouraged with a few basic safeguards in place."

Composing the Body of Your Essay

Step 1 Limit each paragraph to 1 idea.

  • For instance, if you're writing a short research paper, one paragraph might be your main point "Immigration increases diversity," where you cover all your bullet points in that paragraph.
  • If you're digging deeper, you might create a section about diversity, and then use a paragraph to cover "brings in new cuisines," another to cover "brings in new art," and so on.

Step 2 Acknowledge the other side of the issue.

  • Try not to set up a "straw man" argument, where you don't give the other side a fair chance. You should be able to support your position without purposefully creating a weak position on the other side.

Step 3 Keep your whole argument in mind as you write.

  • For instance, maybe you want to transition between a section about increasing diversity to one about bringing in new talent. You might write a sentence like, "Increasing diversity in our country doesn't just bring in new cuisines and art, it also brings in hard workers that have fresh perspectives on old problems in the workforce."

Step 4 Support your ideas with research.

  • You can paraphrase other ideas or use direct quotes, but only use a direct quote if the author said something in a unique way. Otherwise, put it in your own words.
  • You may want to begin body paragraphs with a quote from a relevant source. Then, explain or provide commentary on the quote and show how it supports your position.
  • You can also use statistics to back up your research. For instance, if one of your arguments is that immigration doesn't increase crime, use statistics to back that up.

Concluding Your Essay

Step 1 Synthesize the information from your essay.

  • For instance, you might write, "A truly great country is one that celebrates differences and welcomes new ideas and perspectives. While immigration has some negative effects on a country, overall, allowing people from other countries to come in helps to spark new ideas and make the country a better and more interesting place to live. Rather than being a drain on society, immigrants are motivated to work hard and our citizens can only benefit from listening to their perspectives."

Step 2 Avoid restating your introduction.

  • Once you have the flow down, read it again to check for grammatical mistakes and typos. It can help to read it aloud, as it slows you down and forces you to read every word.

Argumentative Essays

You may have heard it said that all writing is an argument of some kind. Even if you’re writing an informative essay, you still have the job of trying to convince your audience that the information is important. However, there are times you’ll be asked to write an essay that is specifically an argumentative piece.

An argumentative essay is one that makes a clear assertion or argument about some topic or issue. When you’re writing an argumentative essay, it’s important to remember that an academic argument is quite different from a regular, emotional argument. Note that sometimes students forget the academic aspect of an argumentative essay and write essays that are much too emotional for an academic audience. It’s important for you to choose a topic you feel passionately about (if you’re allowed to pick your topic), but you have to be sure you aren’t too emotionally attached to a topic. In an academic argument, you’ll have a lot more constraints you have to consider, and you’ll focus much more on logic and reasoning than emotions.

Argumentative essays are quite common in academic writing and are often an important part of writing in all disciplines. You may be asked to take a stand on a social issue in your introduction to writing course, but you could also be asked to take a stand on an issue related to health care in your nursing courses or make a case for solving a local environmental problem in your biology class. And, since argument is such a common essay assignment, it’s important to be aware of some basic elements of a good argumentative essay.

When your professor asks you to write an argumentative essay, you’ll often be given something specific to write about. For example, you may be asked to take a stand on an issue you have been discussing in class. Perhaps, in your education class, you would be asked to write about standardized testing in public schools. Or, in your literature class, you might be asked to argue the effects of protest literature on public policy in the United States.

However, there are times when you’ll be given a choice of topics. You might even be asked to write an argumentative essay on any topic related to your field of study or a topic you feel that is important personally.

Whatever the case, having some knowledge of some basic argumentative techniques or strategies will be helpful as you write. Below are some common types of arguments.

Causal Arguments

  • You write about how something has caused something else. For example, you might explore the increase of industrial pollution and the resulting decline of large mammals in the world’s ocean.

Evaluation Arguments

  • You can write an argumentative evaluation of something as “good” or “bad,” but you also need to establish the criteria for “good” or “bad.” For example, you might evaluate a children’s book for your Introduction to Educational Theory class, but you would need to establish clear criteria for your evaluation for your audience.

Proposal Arguments

  • With this type of writing, you need to propose a solution to a problem. First, you must establish a clear problem and then propose a specific solution to that problem. For example, you might argue for a removal of parking fines on students who use the parking deck on campus.

Narrative Arguments

  • For this type of argument, you make your case by telling a story with a clear point related to your argument. For example, you might write a narrative about your negative experiences with standardized testing in order to make a case for reform.

Rebuttal Arguments

  • In a rebuttal argument, you build your case around refuting an idea or ideas that have come before. In other words, your starting point is to challenge the ideas of the past. For this type of writing assignment, you have to explain what you are refuting first, and then you can expand on your new ideas or perspectives.

Definition Arguments

  • In this type of argument, you use a definition as the starting point for making your case. For example, in a definition argument, you might argue that NCAA basketball players should be defined as professional players and, therefore, should be paid.

Essay Examples

  • You can read more about an argumentative essay on the consequences of fast fashion . Read it and look at the comments to recognize strategies and techniques the author uses to convey her ideas.
  • In this example, you’ll see a sample argumentative paper from a psychology class submitted in APA format. Key parts of the argumentative structure have been noted for you in the sample.

One of the great struggles for writers in literature is making and sustaining coherent arguments in their papers. Although argument is an essential part of all papers, the literary paper has aspects of rhetoric that are all its own.

A good argument in an essay on literature has:

A tight, specific focus

Rather than broad sweeping statements, a good argument teases out a single aspect of a piece of literature and analyzes it in minute detail: literature under the microscope.

Example: Loose: “Characters in this novel spend time a great deal of time looking at each other, and an examination of those gazes can give us great insight into the characters."

  • Too big. You would have to write a book to do the subject justice.
  • Too general. Whose gaze is being considered? Are we considering the object of the gaze? The person doing the looking? What insight exactly is to be gained?

Tighter: “When the protagonist turns her gaze upon her former lover in their final meeting, it is her own fears, her emotional blindness, and her refusal to learn from the past that can be read in her eyes as she looks upon him."

  • Small. Rather than gazes in general, this statement focuses on one event.
  • Specific. It makes an arguable claim about the implications and suggests a close reading to support those claims.

A step beyond the teacher’s assignment

Some may tell you that a good paper rephrases a writing prompt as a statement rather than a question. Do not believe it. Instructors want to see evidence that you have read the work in question with enough seriousness to reply to the prompts given in your own way. Remember: If an answer seems obvious, keep digging.

A gaze that remains fixed on the work in question

When your argument ceases to discuss the work itself and begins to focus on the personal (your own reaction) or the biographical (the author’s life), you need to get back on track. Make no mistake: a sense of audience and information about the author can be important. When these details become central to the essay, however, you are no longer writing on literature.

Example: “One of the worst parts of this book begins in chapter three when . . .”

This statement reflects a personal reaction to the work. If you want to show that a particular piece or part of a piece is better or worse than others, begin with your evidence rather than starting with emotion.

“This could be a result of the time the author spent in jail in 1938. On the 30th of April he was arrested on charges of . . .”

Although evidence is vital to a sound paper, the statement above focuses on historical rather than critical evidence. If you include biographical information, always be ready to direct that information back into the main point of the essay. Stray from your topic only as long as is strictly necessary.

Academic Writing: How to Argue in an Essay

Something often overlooked in academic writing is that  a good essay  must present a good argument. Admittedly, not a shouting-at-each-other-until-red-in-the-face kind of argument. Rather, it should be a structured set of premises leading to a logical conclusion, backed up by evidence. But what does this mean precisely? Herein, we look at how to argue in an essay.

The Anatomy of an Argument

One key aspect of knowing how to argue in academic writing is understanding what we mean by “argument” in this context: i.e., a set of premises that, together, lead to a conclusion . To explain this further:

  • A “premise” is any statement you hold to be true.
  • A conclusion is a position that follows from the truth of the premises.

For example, we could put forward the following premises:

  • “Dogs are color blind.”
  • “Vincent van Gogh’s paintings are colorful.”

Then, in light of accepting these premises, we would have to accept the conclusion that “Dogs do not appreciate the brilliance of Vincent van Gogh.”

Deductive vs. Inductive Arguments

Part of knowing how to argue involves knowing what kind of argument you’re making. And there are two main types of argument –  deductive and inductive  – though both follow the basic formula set out above.

The stronger of these are deductive arguments, since the conclusion of a deductive argument follows from the truth of its premises:

1st Premise: Dogs are mammals. 2nd Premise: All mammals are vertebrates. Conclusion: Dogs are vertebrates.

Simply put,  you cannot dispute the conclusion of the above argument if you accept the premises. This makes the argument “valid.”

The premises of an inductive argument, by comparison, simply present the conclusion as probable, rather than logically necessary:

1st Premise: My dog is furry. 2nd Premise: My neighbor’s dog is furry. 3rd Premise: Every dog I’ve seen so far has been furry. Conclusion: The next dog I see will be furry.

In the above argument, the premises provide a compelling reason to accept the conclusion. However, they don’t show it is certain, since there are hairless dog breeds, even if they’re rarer. As such, the inductive argument is about plausibility or probability, not logical certainty.

Knowing whether you’re making a deductive or an inductive argument is very important, as it affects the kind of conclusions you can draw.

How to Argue Your Point in an Essay

So, how do you put this into practice in your writing? To make a good argument in an essay, you may need to do several things. These include:

  • Develop a thesis statement . This will outline your premises and the conclusion you will draw. The idea of this to to set up the basic outline of your argument, which you will develop in the main body of your essay.
  • Link the points in your argument. Depending on the length of your essay, address each part of your argument in a separate paragraph or section. In addition, you should discuss them in a logical order, drawing connections between them where possible.
  • Include evidence . In an academic essay, this usually means drawing upon past research (e.g., existing studies) or experimental data (e.g., a questionnaire) to support each point. Without evidence, all you have is an unsupported claim.
  • Consider counterarguments. This lets you address potential objections to your point preemptively, strengthening your own argument.
  • Create a strong conclusion . This should follow clearly from the preceding points (your premises). It’s important to not just summarize your essay, but to also show how the evidence you’ve presented supports your claim and how each point works with the others to contribute to your argument as a whole.

It’s vital to ensure that everything – from the literature review to the conclusion – supports your main argument. Re “ Higher Education Needs More Socrates and Plato ,” by Ezekiel J. Emanuel and Harun Küçük (Opinion guest essay, nytimes.com, May 19):

I applaud Professors Emanuel and Küçük and their call for “more Socrates and Plato” in higher education. I add only that their proposals have long been followed at St. John’s College, which I had hoped would merit a mention, since our practices are uncannily similar to what the professors suggest.

To borrow the words of the professors, we offer a “broad-based” education that spans disciplines and is rooted in Great Books. We do so as preparation for “democratic citizenship,” which we embody in “small seminar discussions” led by teachers who function as guides, not experts.

We even give our students, before their first class, a document that outlines the virtues of brevity, “listening at length” and “being willing to go where the argument leads.” That document, “Notes on Dialogue,” was written by Stringfellow Barr, whose close reading of Plato led him to create the unique program of instruction St. John’s College has offered the American republic for nearly 100 years.

We welcome more Socrates and Plato, but our students have been learning in their demandingly joyful company for quite some time.

What Ezekiel J. Emanuel and Harun Küçük should have highlighted in their otherwise thoughtful argument for renewing higher education’s commitment to “the liberal arts ideals that have made them great” is a more directed focus on what it means to educate students to be intellectuals.

What Socrates, Plato and all the other philosophers and writers whom the authors mention represent are examples of what is historically called “the intellectual.”

Different in form, yet consistent in their desire to know, to learn, to understand, to engage with the hard problems of their day, to discuss, to challenge, to inquire, to provoke, to awaken, to read, to analyze, to reflect: These are the qualities of the intellectual, and we should be educating our college students to embody and practice these dispositions and habits of mind and body from Day 1.

Civic education, as the authors discuss it, should start in early childhood. But anti-intellectualism has so rooted itself in the fibers of higher education that to argue for a liberal arts education is controversial. To argue for educating students to be intellectuals is radical.

As a lifelong educator, I think the great books and the great debates over the great questions should be done in high school or even earlier. Why wait until college to engage young people in citizenship? This way when students graduate the foundation is there already, no matter what path they decide on — college or no.

Wasn’t that the idea of public schooling to begin with? Don’t we want to teach to the imagination of students and not just equip them with functional skills?

Re “ Election Updates: Tim Scott Says That Black Americans Would Be Better Off Under Trump ” (nytimes.com, May 26):

I want Senator Tim Scott to explain how Black Americans would be better off under another Trump administration. Mr. Trump has said that he wants to cut back on federal programs like Medicare, Medicaid and Social Security that a large number of Black Americans rely on. He wants to replace Obamacare — again a program that many Black Americans rely on — with what is not exactly clear. He wants to end diversity and inclusion programs.

The White House Office of Environmental Justice will surely be closed. I can’t even begin to list examples of Mr. Trump’s history of racism, starting with refusing to rent to Black tenants , wanting the death penalty for the Central Park Five , etc., etc.

What is good for Black Americans about this? Does Senator Scott think they are as gullible as he is?

“ Threats and Fear Are Transforming U.S. Politics ” (front page, May 20) does an important job of highlighting the “steady undercurrent of violence and political risk that has become the new normal” for our public officials.

I just returned from Northern Ireland, a place that experienced decades of civil war; this spring marks 26 years of peace. I was there with a cross-partisan group of U.S. faith leaders and former politicians to learn how Northern Ireland overcame seemingly intractable, violent, identity-based division.

Three main lessons came through. First, when you hold a mirror to American society, we are much further along the path to normalized violent conflict than we know. Second, prolonged violent conflict leads to immense suffering and destruction. Third, a return to peace is never quick.

And the hopeful lesson is that people who used to hate, bomb and maim one another could find common ground. They found this in exhaustion from the killing and pain, a desire for better lives for their children and a sense of common humanity. By painstaking and determined conversation, they found a way to agree. We, in the U.S., need to do the same.

Re “ Homeowners Who Planned to Demolish Marilyn Monroe House Sue Los Angeles ” (news article, nytimes.com, May 8):

Marilyn Monroe’s housekeeper once said that her Brentwood home, with its thick beams and walls, made the actress feel safe. It became her refuge, a place where she could go when the world became too much. It was also the place where Marilyn kept her beloved collection of books and other items she treasured.

The house wasn’t fancy by Hollywood standards, but it was solely hers, and she loved it. If her “spirit” resides anywhere today, it’s there. Marilyn herself has become a global symbol of not only glamour and sex, but also personal perseverance and courage in the face of great odds. All good reasons to save her beloved Brentwood home from the wrecking ball.

I serve as the vice president of programs at Chicago Scholars , a nonprofit that serves students from low-income households or who will be first-generation students and want to attend a four-year college. The FAFSA mishap upended the college decision season for everyone in our organization, and finding workarounds has unfairly fallen to our students and counselors.

Roadblocks like this forced students to choose between a provisional financial aid package and a gap year. Unfortunately, we find that Chicago Scholars students who take a gap year are far less likely to earn a degree. For many of our students, a college degree is the most attainable path to economic mobility, and it is a path they have worked hard to access.

Our students deserve more than they’ve been given in this situation. This latest misstep is only further evidence that they continue to be left behind.

T his week, two attorneys will stand and make their cases to the jury. Yes, that jury and that trial , which may put a former--and future?--president behind bars. This is when the pressure falls on the prosecution and defense to make their final claims of guilt or innocence.

"At this point, parties are free to use hypothetical analogies to make their points; to comment on the credibility of the witnesses, to discuss how they believe the various pieces of the puzzle fit into a compelling whole, and to advocate why jurors should decide the case in their favor," explains the official site of the Federal Court System.

Or, we can just recall the most memorable, decisive arguments made on screen. Hey, we can handle the truth!  Here is my list of 10 to remember.

"To Kill A Mockingbird"

Gregory Peck won the Oscar -- even though he didn't win the case -- as Atticus Finch, the courageous lawyer defending an innocent Black man in Maycomb, Alabama. "To begin with, this case should have never have come to trial," he said. "It is as simple as black and white. The state has not produced one iota of medical evidence to the effect that the crime Tom Robinson is charged with ever took place. The defendant is not guilty, but somebody in this courtroom is." The jury -- all white -- votes for conviction.

"Judgment at Nuremberg"

In this case, Maximilian Schell won an Oscar -- and lost his case -- defending those who followed orders in the concentration camps. He not only reminded jurors that the accused were simply following orders, but that other countries -- including our own -- were possibly no better. "What about the rest of the world? Did you not know the intentions of the Third Reich?" He goes on to mention Hiroshima and Nagasaki. Ouch. The man who will face his fate this coming week is already promising a "unified Reich." Ouch again.

"The Verdict"

This is the movie that started Paul Newman's incredible final run of great performances. As Frank Galvin, a formerly down-on-his-luck lawyer, he rises to the occasion on a medical negligence case. Reading David Mamet's powerful and relatable words: "You know, so much of the time we're just lost. We say, 'Please, God, tell us what is right; tell us what is true. And there is no justice: the rich win, the poor are powerless. We become tired of hearing people lie. And after a time, we become dead… a little dead.'" The verdict - as well as "The Verdict" -- was a positive one.

"Inherit the Wind"

Who can forget Spencer Tracy's outraged and horrifyingly prescient words as he reaches the boiling point, repeating the expertise of six noted scientists? "Their testimony is basic to the defense of my client… This community is an insult to the world. I think my client has already been found guilty. If you make it a crime about teaching evolution in the public school, tomorrow it will be in the private schools and soon you may ban books and newspapers."

"My Cousin Vinny"

As a murder trial, in a backwater Alabama town, progresses, New York lawyer Vinny--who has never won a case–agrees to represent his cousin and another friend. He ultimately sways the jury, earns the respect of district attorney Jim Trotter, and wins over several of the small town's residents. (His girlfriend, played by Marisa Tomei, won over Oscar voters) Ultimately, when Vinny emerges victorious, even the judge is full of praise. Vinny, he claimed, is "one hell of a trial lawyer."

"Philadelphia"

Tom Hanks won the Oscar as the AIDS victim at the center of this case, but Denzel Washington's defense is nothing short of brilliant. "Let's talk about what this case is really about," he says. "Our loathing and our fear of homosexuals. (Both of which he himself had early in the film) And how that translated into the firing of my client." The jury votes in Hanks' favor, awarding him back pay, damages for pain and suffering, and punitive damages, totaling over $5 million.

"Legally Blonde"

In the final court scene in the film, Elle Woods, played by Reese Witherspoon, confidently defends her client and proves herself as a capable lawyer. The scene showcases the power of determination, intelligence, and resilience in the legal field.  Okay, it wasn't her closing argument, per se, but her commencement speech. Yet, it is what young women, in particular, remember. And what Donald Trump heavily "lifted" for his 2017 speech at Liberty University. Suffice to say, the late night shows had a blast with that one.

"Adam's Rib"

In this 1949 "romcom," a married couple played by Katharine Hepburn and Spencer Tracy end up on opposite sides in court. Hepburn represents a woman who shot her cheating husband, arguing, "consider this unfortunate woman's act as though you yourselves had each committed it. Assault lies dormant within us all. It requires only circumstance to set it in violent motion. There was no murder attempt here, only a pathetic attempt to save a home." She wins the case, and her own marriage survives.

"On The Basis of Sex"

In this 2018 film, Ruth Bader Ginsburg is a struggling attorney and new mother. When she takes on a groundbreaking case--one dealing with discrimination of both sexes–she knows it could change the direction of her career. In the title role, Felicity Jones argues,  " The principle purpose of  Section 214 is to provide caregivers the opportunity to work outside the home. Therefore, this court should fix the law [in the way] most in line with the legislative intent. Extend the deduction to never-married men. Help all caregivers equally." The case was a winner.

"Knock on Any Door"

This 1949 drama gave Humphrey Bogart one of his best roles, as defense attorney Andrew Morton. Just as he is about to be made a partner at a snazzy law firm, a voice from the past--that of his old client Pretty Boy Romano--yanks him back to his roots. Ultimately, Morton's only hope is to argue against the death penalty itself. "Nick Romano is guilty," he says. "He's guilty of knowing his father died in prison, of having lived in slums, of the foul treatment of a primitive reform school. He is guilty, but so are we, and so is that precious thing called society. If he dies in the electric chair, we killed him."

Trump trial recap: Jury asks to see testimony from Michael Cohen and David Pecker

NEW YORK − Former President Donald Trump’s fate rests in the hands of  12 Manhattan jurors in his historic  hush money trial , with the verdict carrying the potential to alter the 2024 presidential campaign.

The jury sent a note shortly before 3 p.m. EDT requesting to review four sections of testimony from the trial, three from media executive David Pecker , and one from former Trump lawyer Michael Cohen . Almost an hour later, the jurors sent a second note asking to re-hear the jury instructions.

Jurors were sent home for the day at 4:07 p.m. EDT. They will resume deliberations Thursday.

Jurors began deliberating Wednesday after hearing  six weeks of testimony from a parade of  22 witnesses , including a felon convicted of perjury, a porn actress, and the former head of the parent company for the National Enquirer tabloid.

Any verdict requires a unanimous vote. The outcome – a conviction on all or some of 34 counts of falsifying business records, an acquittal or a deadlocked jury – could have a major impact on Trump’s campaign against President Joe Biden .

Trump is polling ahead of Biden despite the criminal charges in this and three other cases, but a felony conviction could sway some voters against him. An acquittal could bolster his claims that he was the victim of a politically motivated prosecutor.

Trump complains key witnesses weren’t called to testify – by prosecution or defense

Former President Donald Trump complained to reporters Wednesday that prosecutors didn’t call potential witnesses in his New York hush money trial, but didn’t explain why his team didn’t ask them to testify instead.

“There are a lot people that they could have called that they didn’t call,” Trump said. “They didn’t call them obviously because they would have been very bad witnesses for them. Take a look at the list. You have a lot of big players that would have solved their problem or given us the win.”

Trump declined to name them because a gag order prohibits him from commenting on potential witnesses. But he seemed to suggest Allen Weisselberg , the Trump Organization’s former chief financial official, is one of the possible witnesses. Weisselberg is serving time on Rikers Island after being convicted of perjury in an early Trump trial.

“In particular, one witness is now suffering bravely because of the viciousness of these thugs,” Trump said. “You know who I’m talking about. They didn’t call him as a witness.”

Prosecutors had said they wanted to call Weisselberg but couldn’t because he was jailed. Trump’s former personal lawyer, Michael Cohen, testified that Weisselberg helped arrange his reimbursement from Trump for paying $130,000 to porn actress Stormy Daniels to keep her quiet about an alleged sexual episode with Trump before the 2016 election.

Wednesday proceedings end

Judge Juan Merchan asked the prosecution and defense to send court reporters tonight a neat outline of the decisions on the pages and lines of the trial transcript to be read back to jurors on Thursday.

Merchan then dismissed the parties at about 5:26 p.m. EDT. "I'll see you tomorrow morning at 9:30," he said.

Trump has eyes closed as lawyers and judge discuss jury transcript review

Former President Donald Trump again has his eyes closed for extended periods, this time as the lawyers and Judge Juan Merchan discuss which portions of the trial transcript should be read back to jurors on Thursday.

At one point, I counted to 37 with a "Mississippi" in between each number before he opened his eyes. Trump peered out only briefly before closing them again.

Not long after, I counted to 49 at the same pace before he opened his eyes. This time, he looked as if he might be falling asleep . His head was drooped down in front of him.

Lawyers disagree about one of four jury transcript requests

Prosecutor Joshua Steinglass said the two sides have agreed on the portions of the trial transcript to be read back to jurors in response to three of their four transcript requests. The request that has sparked multiple disagreements is former tabloid publisher David Pecker's testimony about a Trump Tower meeting he said he had with Trump and Michael Cohen in August of 2015.

Pecker testified that he agreed at that meeting to be "eyes and ears" when it came to catching potential stories in the media market that could hurt Trump's first presidential campaign.

Judge Merchan resolved one of the disputes in the courtroom after reviewing the transcript himself. He said he was largely – though not entirely – accepting the proposal from the defense.

On two other disputes, Merchan said he will review the transcript portions later and let the parties know what he thinks.

Judge returns to address transcript read-back for jurors

Judge Merchan returned to the courtroom and addressed the lawyers.

"Okay, where do we stand?" Judge Merchan asked.

Prosecutor Joshua Steinglass said he thinks the two sides have made "a lot of progress," but there are a couple issues they may need him to resolve.

Trump re-entered the courtroom at about 4:55 p.m. EDT. However, the lawyers are still talking to each other and Judge Merchan hasn't returned to the courtroom.

For example, they say Trump is only guilty of a felony count of falsifying business records if he falsified a record in order to interfere in the 2016 presidential election through at least one of three unlawful methods spelled out in the instructions.

Trump permitted to leave courtroom while staying in waiting area

The judge just approved a request from Trump lawyer Todd Blanche for his client to leave the main courtroom simply to go to a nearby courtroom that is a typical waiting area for him. The lawyers have remained in the courtroom to resolve the question of what trial transcript portions the jury will have read back on Thursday.

Trump defense team, prosecutors remain to work on transcript

After excusing the jurors for the rest of the day, Judge Merchan told the prosecution and defense to stay until the court has settled on the precise transcript read-back the jurors are slated to hear on Thursday.

Trump has eyes closed as judge instructs jurors on not discussing case

Former President Donald Trump had his eyes closed for extended periods as Judge Merchan gave the jurors standard instructions on not discussing the case upon leaving for the day.

I counted to 25 with a "Mississippi" in between each number at one point before Trump opened his eyes, and to 28 at that same pacing a little later.

There's an air of activity and suspense in the courtroom after hearing the first updates during jury deliberations. It's hard to reconcile that with the notion that Trump is actually falling asleep right now, as opposed to choosing to sit with his eyes closed.

Jurors return to courtroom and are sent home for day

The jurors were brought back into the courtroom. Judge Merchan read aloud the two notes he received from them. He told them reading back the portions of the transcript they requested will probably take at least half an hour. He asked whether they want to hear all the jury instructions again or only a portion of them, and said they can let him know later.

Merchan then excused them for the day .

Jurors send second note to judge, want to re-hear instructions

As lawyers and the court were working on putting together the portions of the trial transcript that will be read aloud to the jurors, Judge Merchan entered the courtroom and announced he had received a second note from the jurors at 3:51 p.m. EDT. They requested to re-hear the jury instructions.

Merchan recommended to the two sides bringing the jurors back into the courtroom. He proposed telling them the court is working on getting the transcript portions together, and asking them if they want to hear all the instructions again or only a portion of them.

Jurors ask to review testimony from trial

The jurors sent a note at 2:56 p.m. EDT asking to review four sections of testimony from the trial, Judge Merchan just announced.

Reporters were sitting in the main courtroom when the prosecution entered at about 3:06 p.m. EDT, followed quickly by Trump and his lawyers. We weren't told in advance the reason for their arrival.

Merchan then entered the courtroom and said the jurors want to review these four sections of trial testimony:

  • David Pecker's testimony about a phone conversation with Trump while Pecker was in an investor meeting;
  • Pecker's testimony regarding the decision not to finalize and fund the assignment of former Playboy model Karen McDougal's life rights;
  • Pecker's testimony regarding a Trump Tower meeting he said he had with Trump and Michael Cohen in August of 2015; and
  • Cohen's testimony regarding that same Trump Tower meeting.

Pecker used to run the parent company for the National Enquirer, which was involved in two hush money deals related to Trump ahead of the 2016 presidential election. One of those deals involved buying the life rights to McDougal's story of a months-long affair with Trump, which he denies.

Pecker and Cohen met with Trump in August of 2015 at Trump Tower to discuss helping catch stories that might hurt Trump's presidential campaign and then prevent those stories from getting out, according to their testimony.

Jurors will be brought in to have those portions of the trial transcript read aloud, Merchan indicated.

Prosecution cites 'jaw-dropping' evidence against Trump that defense says 'cannot be trusted'

The six-week trial featured dramatic clashes between lawyers and witnesses, the judge and Trump.

The testimony included tense moments such as defense lawyer Todd Blanche accusing Trump’s former personal lawyer, Michael Cohen , of lying on the standand former Trump spokesperson Hope Hicks breaking into tears .

Meanwhile, Judge Juan Merchan threatened to jail Trump if he continued to violate a gag order against talking about witnesses participating in the case. Merchan also scolded Blanche for an “outrageous” statement in closing arguments that the jury shouldn’t “send someone to prison” based on Cohen’s testimony.

A flock of Republican surrogates showed up to support Trump, and one conspiracy theorist set himself on fire outside the courthouse.

Cohen was a key witness testifying that he submitted invoices for “legal expenses” that Trump knew were to reimburse him for paying $130,000 to silence porn actress Stormy Daniels before the 2016 election. But Trump lawyer Todd Blanche accused Cohen of lying on the stand when he testified he notified Trump about the payment to Daniels. In closing arguments, Blanche called Cohenthe “MVP of liars” and “the embodiment of reasonable doubt.”

Daniels, whose real name is Stephanie Clifford, described the alleged sexual encounter in enough detail that Merchan questioned why defense lawyers didn’t object more to block her testimony. She testified that she noticed gold nail clippers in Trump’s hotel room and he didn’t wear a condom during the encounter. Trump has repeatedly denied he had sex with Daniels and Blanche argued the payment “started out as an extortion” whether the allegation was true or not.

David Pecker, the former CEO of American Media Inc., which owned the National Enquirer, said he agreed in a meeting with Trump and Cohen in August 2015 to be the “eyes and ears” of Trump’s presidential campaign to buy negative stories about the candidate and never publish them.

Pecker acknowledged paying former Playboy model Karen McDougal $150,000 for her story and then refusing to pay for Daniels because Trump hadn’t reimbursed him. Cohen provided a recording , which prosecutor Joshua Steinglass called “jaw-dropping,” of Trump mentioning the $150,000 figure.

But Blanche raised questions about the credibility of the recording because it cuts off suddenly – Cohen said he got another call – and argued that a meeting to influence the campaign “made no sense.”

Trump paid Cohen for a retainer through invoices marked "legal expenses," so he committed no crime of falsifying business records, according to Blanche. "This is not a referendum on your views of President Trump," Blanche told jurors.

Donald Trump: ‘Mother Teresa couldn’t beat these charges’

After the jury began deliberating in former President Donald Trump’s hush money trial, Trump braced his supporters for a guilty verdict by claiming nobody could be acquitted because of the way Judge Juan Merchan instructed jurors to consider the charges and the evidence.

“Mother Teresa could not beat these charges,” Trump said. “These charges are rigged. The whole thing is rigged.”

Trump went on to say that he would win the Nov. 5 election against President Joe Biden because of border security, inflation and other issues.

“We’re going to win this election,” Trump said. “We’re going to take back this country from these fascists and these thugs that are destroying us.”

At about 11:35 a.m. EDT, all jurors had exited the courtroom and Judge Merchan instructed the parties to remain in the courthouse in case they are needed as the jury begins deliberating.

The two jurors who volunteered to handle the laptop with evidence appeared to be given some instructions at the prosecution's table, and then left. Judge Merchan just confirmed with Trump lawyer Todd Blanche that Trump has consented to the jurors' use of the laptop to access trial exhibits.

Alternate jurors excused from courtroom, two main jurors coming for laptop instructions

Judge Merchan excused the alternate jurors from the courtroom but is having two of the main jurors brought back in. He said they have volunteered to handle the laptop containing evidence from the trial, and will be given some instructions on that.

12 jurors excused from courtroom, alternate jurors remain

Judge Merchan had the 12 jurors who will begin deliberating leave the courtroom, but kept the six alternate jurors in the courtroom. He has now praised their attentiveness during the trial and explained they are not done – they are still on duty in case any of the 12 can't continue through deliberations and alternates are needed to step in.

Judge makes clarification on juror signature

After conversing with the lawyers privately, Judge Merchan clarified to jurors that one instruction about a signature tied to juror notes was about the jury foreperson denoting he signed the document, not having a juror sign a personal name.Merchan also explained jurors will be given a laptop containing evidence from the trial during their deliberations.

'That concludes my instructions on the law'

"That concludes my instructions on the law," Judge Juan Merchan just told jurors. He invited the parties to approach, and several lawyers are now having a private conversation with the judge at his bench.

Judge Merchan just told jurors the plan today is to work until 4:30 p.m. EDT. He said the plan for other days will be figured out if that is needed. He also said it's unlikely, if jurors do work late, that their work will extend beyond 6 p.m. EDT.

Judge instructs jurors on the law of falsifying business records

Judge Merchan just reached the 34th and final count in his jury instructions. Along the way, he has explained to jurors that Trump is guilty of falsifying business records in the first degree under New York law if he made or caused a false entry in a business enterprise with the intent to defraud – including the intent to commit or conceal another crime.

That means prosecutors must have proven during this trial not just that Trump is responsible for false records, but also that there was a further criminal or cover-up purpose. That's where alleged 2016 election fraud and alleged plans to violate New York tax and election laws come into play in this case .

Merchan told jurors that intent doesn't require premeditation, but instead can be formed at the time the defendant engages in prohibited conduct.

"You must decide if the required intent can be inferred beyond a reasonable doubt," Merchan said.

One juror looking at trial teams as Trump leans back with eyes closed

The jurors have largely been taking notes and looking at Judge Merchan as he gives them instructions on the law in the case. But one juror who is among the first 12 who are slated to decide the case – not an alternate juror who is here to step in if one of the 12 becomes unavailable – has been looking over at the trial teams for several seconds. There, Trump can be seen slouching back in his chair with his eyes close, in stark contrast to the open-eyed, attentive jurors.

Big rally near the Trump courthouse – for elderly services

No, not at the demonstrations in front of the Trump courthouse – it’s a rally for New York elderly services one block over in Foley Square.

While the relatively few pro-Trump and anti-Trump forces argue – in one instance requiring police intervention – hundreds of other New Yorkers are boogying to immortal classics like “Get Down Tonight” and “Disco Inferno.”

Sample lyrics from the latter: “Folks are screaming, out of control/It was so entertaining when the boogie started to explode/I heard somebody say disco inferno/(Burn baby burn)/burn that mother down.”

Trump eyes closed for more than 100 seconds

Former President Donald Trump isn't fully asleep, but it appears he may be dozing off . I just counted to 100 with a "Mississippi" in between each number while his eyes remained closed. I stopped counting at that point. For the first approximately 30 seconds, Trump was slouched forward in his chair, with his head slightly hanging in front of his shoulders. He then slouched back without opening his eyes. I saw him shake his head slightly once, but apart from that he doesn't seem to be showing a facial reaction to the judge's instructions to jurors.

The jurors in this case have been very attentive throughout the trial, even through a long day of closing arguments on Tuesday that didn't wrap until about 8 p.m. EDT.

Judge Merchan has just instructed jurors they must not consider Michael Cohen's guilty pleas to federal campaign finance violations when it comes to assessing Trump's guilt in this case. It's an instruction Merchan also gave jurors during testimony in the trial.

Prosecutors have alleged Trump falsified records to cover up unlawfully interfering in the 2016 presidential election through a hush money payment to porn star Stormy Daniels that violated federal campaign finance laws.

Judge begins giving jury instructions

Jurors entered the courtroom at 10:10 a.m. EDT and Judge Juan Merchan has begun delivering instructions to them. He told them to remember they promised to be fair jurors. He told them they must not allow any bias or stereotype to affect their verdict.

What is the Trump trial about?

Trump's New York criminal trial centers on a hush money payment to porn star Stormy Daniels , business records kept at the Trump Organization, and the 2016 presidential election.

Prosecutors have alleged that Trump falsified business records to cover up a $130,000 payment to Daniels less than two weeks before the election. They say the payment violated federal campaign finance laws, and as a result constituted unlawful election interference.

Former Trump lawyer and fixer Michael Cohen made the payment and later became a star witness for the prosecution in Trump's case.

Trump defense lawyer Todd Blanche suggested to jurors in his Tuesday closing argument that Cohen acted alone and lied about Trump authorizing the payment. Who is Judge Juan Merchan?

Judge Juan Merchan is a former prosecutor who has served as a judge since 2009. Merchan previously presided over a criminal trial in which two Trump businesses – the Trump Corporation and the Trump Payroll Corporation – were found guilty of several crimes , including tax fraud. The two companies were sentenced to pay more than $1.6 million following the verdict.

Merchan has frequently drawn the ire of former President Donald Trump, who just this morning posted in all caps on Truth Social that Merchan is "A CORRUPT AND CONFLICTED JUDGE" presiding over a "KANGAROO COURT!"

The judge imposed a gag order on the former president that prohibits public comments on jurors or on the participation of witnesses in the case. The order also provides some protection from Trump's ire for prosecutors and their family members, as well as for family members of the judge. Merchan imposed the order after concluding that Trump's past "inflammatory" statements instilled fear in people involved in his legal cases and heightened security needs.

Merchan expanded the order to cover his own family members and those of Manhattan District Attorney Alvin Bragg after Trump attacked the judge's daughter for her work at a marketing agency that assists Democrats.

Trump responds to actor Robert De Niro as ‘small’ and ‘Wacko’

Former President Donald Trump responded early Wednesday on social media to actor Robert De Niro ’s criticism, calling him a victim of “Trump derangement syndrome.”

“I never knew how small, both mentally and physically, Wacko Former Actor Robert De Niro was,” Trump wrote on Truth Social.

A movie star for more than 50 years, De Niro won Oscars for his performances in The Godfather Part II and Raging Bull. But Trump said his participation in politics diminished his value.

“Robert, whose movies, artistry, and brand have gone WAY DOWN IN VALUE since he entered the political arena at the request of Crooked Joe Biden, looked so pathetic and sad out there,” Trump wrote.

Melania Trump has so far stayed away from her husband's criminal proceedings. The former president wished her a "happy birthday" from the courthouse hallway when he attended proceedings on her birthday, April 26. He said he would join her in Florida later that Friday.

Actor Robert De Niro, surrogate for President Biden, blasts Trump as ‘clown’ outside courthouse

Oscar-winning actor Robert De Niro called former President Donald Trump a "clown" and a “buffoon” bent on destroying American democracy from outside the courthouse on Tuesday.

De Niro was flanked by two former Capitol Police officers, Harry Dunn and Michael Fanone, who defended the Capitol during the attack Jan. 6, 2021, by Trump supporters.

"We've forgotten the lessons of history that showed us other clowns who weren't taken seriously until they became vicious dictators," De Niro said. "With Trump we have a second chance and no one is laughing now. This is the time to stop him by voting him out once and for all."

De Niro’s appearance served as a Democratic response to Republican lawmakers and vice presidential contenders who criticized the trial for Trump because he was gagged from commenting on witnesses or jurors. Trump’s sons Don Jr. and Eric, and daughter-in-law Lara, who is co-chair of the Republican National Committee, spoke for the former president Tuesday.

Will Tiffany Trump, other Trump children, be at the trial Wednesday?

Trump's youngest daughter, Tiffany , attended the Manhattan criminal trial for the first time Tuesday. Trump sons Eric and Don Jr., who have attended some earlier days, were also there. It's not yet known which Trump children, if any, will come today.

Ivanka Trump and Jared Kushner haven't attended any of the criminal trial. Barron Trump , who just graduated from high school, also hasn't attended proceedings. His parents went to his high school graduation on May 17, a day Judge Juan Merchan allowed Donald Trump to have off in the trial so he could be with his youngest child.

How long will the jury take to deliberate?

No one, not even the jury, knows that yet.

First, jurors all meet in the jury room to discuss their views. They have an opportunity to send requests for clarifications or further instruction to the judge. They must come to a unanimous decision to convict or acquit, or else the trial will end in a " hung jury ," forcing a mistrial.

Judge Juan Merchan said Tuesday that he will deliver jury instructions in the morning, estimating it will take him about an hour.

Jury instructions are critical because they inform the jurors about the law to apply in the case. Small words in jury instructions can sometimes make a big difference as jurors are tasked with deciding not just what the defendant did in a given case, but also whether it's a crime.

What did the defense say about Cohen on Tuesday?

Trump lawyer Todd Blanche was full of invectives for Michael Cohen as he urged jurors on Tuesday not to credit the former Trump fixer's testimony. Cohen testified that Trump authorized him to make a $130,000 hush money payment to porn star Stormy Daniels ahead of the 2016 presidential election, and approved a plan to cover it up even as he reimbursed Cohen in 2017.

"He's literally like an MVP of liars," Blanche argued.

"In fact, he's also a thief," Blanche said. Cohen himself admitted on the witness stand to stealing by claiming a larger reimbursement from the Trump Organization than Cohen actually paid for polling-related help for Trump.

Blanche also accused Cohen of committing a crime at the trial by lying on the witness stand . The defense lawyer pointed to text messages indicating Cohen called Trump's bodyguard on Oct. 24, 2016 about harassing calls he was getting. Confronted with the messages, Cohen largely stuck to his previous testimony, saying he believed he also spoke to Trump about hush money to Stormy Daniels during that call.

"It was a lie!" Blanche exclaimed Tuesday. "That is per-jur-y," he also said, putting emphasis on each syllable of the crime.

"He got caught red-handed," Blanche told jurors.

What is Trump on trial for?

Trump faces 34 felony counts of falsifying business records to commit or conceal another crime. Prosecutors have said Trump was falsifying records to hide the violation of federal campaign finance laws and to hide plans to violate New York tax and election laws.

Trump wanted to hide a $130,000 hush money payment to porn star Stormy Daniels in particular, according to prosecutors. They say the payment violated federal campaign finance laws and amounted to election fraud.
